Ken & Dana Design and its subsidiaries and corporate affiliates (collectively, “our” or “us” or “we”), operate and provide services through the website shop.kenanddanadesign.com/ and related mobile applications, as well as any publicly available versions that may be offered through a distribution partner (collectively the “Site” or “Ken & Dana Design”). Before registering for Ken & Dana Design, we ask that you carefully read our Privacy Policy. If you do not agree with this Privacy Policy without limitation or qualification, you are not permitted to use Ken & Dana Design and must immediately discontinue such access. By accessing, using, or browsing Ken & Dana Design you acknowledge and confirm that (1) you have read and understand all of the terms and conditions herein; (2) you agree to be bound by all of the terms and conditions of this user agreement and acknowledge that this agreement is the legal equivalent of a signed, written contract between Ken & Dana Design and; (3) you have full authority to bind yourself or your entity to all the terms and conditions of this agreement.

Why Do We Have This Privacy Policy?

At Ken & Dana Design, we believe that transparency is important. We are a small family store and take pride in our handcrafted, locally made jewelry. We want to hold ourselves to the highest standards not only in our lasting creations, but our business as well. We have decided to create this section to explain how we value your privacy.

Minors

Our site is intended for adults and targeted to individuals over the age of 18 years, or the age of consent in your jurisdiction. Accordingly, we do not collect any information from minors.

What Information We Collect

When signing up for our site, we collect and store certain information from you, such as your name, address, email, telephone number, billing address, shipping address, and/or home address. We will only collect this information if you input it into our system, such as when you sign up for our newsletter, or purchase one of our beautiful pieces of custom jewelry. We may also collect any information that you input as part of a questionnaire or survey, such as your likes and dislikes, choice of gem stone, gender, demographics, age, and your spouse’s information.

We also try to ensure that our website has the best user experience and will reach as many customers as possible. We will therefore use third party services, such as Facebook Lead Ads, and Google Analytics. These third-party services will sometimes collect information from you automatically, such as your location, I.P. address, user names, log in history, time spent on our page, referring search engine (Google, Yahoo, Bing, etc.) or website, and view history. We have no control over how these third-party websites obtain information, and we take no responsibility for any information that is collected by these service providers or their privacy policies. Our website may also collect information about how you are accessing us, such as through your cell phone or web browser, and which pages or pieces of jewelry you view. We will never install any third-party software on your devices.

Why We Collect Certain Information

We collect this information in order to make your shopping experience more pleasurable. We want to know what pieces you prefer and what is important to you. This information also allows us to tailor the content of our website and marketing materials so that you can learn more about us. We may send you emails which include newsletters or special promotions. We may also collect your information to comply with legal and regulatory obligations or law enforcement and other investigations. For example, if someone steals your credit card information and makes a fraudulent purchase, we will be able to provide the authorities with the location where the purchase was made.

We take your privacy very seriously. Therefore, we will never sell, trade, or otherwise transfer your personal information for a fee. If for some unlikely reason we sell our business, or our assets are acquired, your personal information may be transferred or acquired by that third party as well. You acknowledge that, unless you opt out, that third party may use your information as well.

How We Collect Information

We use cookies for a number of reasons, including to help us remember and process items in your shopping cart as well as to assist us in tailoring our services to your interests based on site activity. Our third-party partners, which include but are not limited to Facebook, Google and Criteo, may also collect information through the use of cookies, pixel tags, beacons, clear GIFs, and other similar tracking technology such as advertising IDs in environments that do not support cookies - that they have created to provide measurement services and serve targeted advertising based on your past visits to our website. Note for Our Customers in California and Outside the United States

Our family company is located in New York City. We intend for our services to be directed to those residents of the United States and we expect and intend our users to be from the United States. If you have found our website while you are in the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please note that your continued use will show your intention to be bound by the laws of the United States and we do not consent to any other jurisdiction. In fact, you expressly understand that you are consenting to have your information directed at the United States and to it being collected under the laws of the United States.

We also want to let our California users know that California Civil Code Section 1798.83 permits, once a year, California residents to request information relating to third parties for direct marketing purposes. Security and Limitations on Liability

We try our hardest to make sure your information is secure. We deal with only reputable merchant processors and companies.

You release Ken & Dana Design, its affiliates, and their respective directors, officers, employees, and agents from all liability related to any and all claims and demands you may assert against any third party arising out of our service. If you are a California resident, you waive California Civil Code Section 1542, which states, "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release which, if known by him or her, must have materially affected his or her settlement with the debtor.

Subpoena Policy

Except as otherwise provided in this agreement, Ken & Dana Design will keep confidential all information supplied by you, and shall use or disclose such information only for the purposes for which such information was collected, or as required by law.

Notwithstanding the foregoing, from time to time, Ken & Dana Design may receive subpoenas seeking the identity of a member. In the event Ken & Dana Design does not object to the disclosure, it may forward a copy of the subpoena to you at the email address you provided in your account registration so that you may take action on your own behalf. Should you fail to respond to our e-mail and/or you otherwise fail to timely object to the subpoena or make other arrangements with the requesting party, Ken & Dana Design may, without notice, comply with the subpoena which may disclose your identity without incurring any liability to you.

In its sole discretion, Ken & Dana Design may also disclose your identity to any federal, state, or local law enforcement agency (including federal and state attorneys general) for the limited purpose of allowing such agencies to investigate unlawful acts.

You further agree to release and hold Ken & Dana Design harmless from any claims that Ken & Dana Design disclosed your identity pursuant to this Privacy Statement.

Changes

We reserve the right to make changes to this Privacy Policy from time to time in our sole discretion. It is your responsibility to visit this section and see what changes, if any, are made. By continuing to use our site, you consent to any changes that are made.
